These Terms of Service ("Terms") govern your access to and use of Ocus Studio (the "Service") operated by OCUS Inc., a Delaware corporation ("Ocus", "we", "us"). By creating an account, subscribing to a plan, or otherwise using the Service, you ("Customer", "you") agree to be bound by these Terms.
If you are entering into these Terms on behalf of a business, you represent that you have authority to bind that business and that you are at least 18 years old.
Ocus Studio is a self-serve software platform that enables food and hospitality businesses to (a) generate social media content, including videos, carousels and images, using artificial intelligence; (b) caption, schedule, and publish that content to connected social media accounts (Instagram, TikTok); and (c) access related features including trends, insights, and analytics. Additional features may be introduced, modified, or discontinued from time to time.
To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use. Accounts are intended for a single business; you may not resell or share account access without our prior written consent.
Plans. The Service is offered under tiered monthly subscription plans. The plans, prices, and credit allotments published at getviral.ocus.com at the time of subscription apply.
Credits. Each plan includes a monthly allotment of credits used to perform actions in the Service (for example, generating a carousel or editing a slide with a prompt). Credits do not roll over between billing periods. Unused credits expire at the end of each billing cycle and have no monetary value.
No refunds. Subscription fees and credits are non-refundable, in whole or in part, under any circumstances — including unused credits, partial-month usage, or cancellation prior to the end of a billing period.
Top-ups. Additional credit packs may be purchased at the prices listed at the time of purchase. Top-up credits follow the same expiration rules as plan credits unless otherwise stated.
Pricing changes. We may change subscription prices at any time. Price changes will take effect at the start of the next billing cycle following at least thirty (30) days' notice.
Subscriptions are billed in advance on a monthly basis to the payment method on file. Payments are processed by Stripe (PCI-DSS Level 1 certified). Ocus does not store or have direct access to your payment card details. All prices are in U.S. dollars and exclusive of any applicable taxes, which will be added where required by law. Failure to collect payment may result in suspension or termination of your account.
Your subscription begins on the date you subscribe and renews automatically each month until cancelled. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to the Service through that date, and no further charges will be made. We may suspend or terminate your account at any time for breach of these Terms, non-payment, fraud, or abuse.
